1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Nextcone Technologies Limited ("Nextcone", "we", "us", or "our"), concerning your access to and use of the Eventcone platform (the "Service").
By accessing the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
2. Description of Service
Eventcone is a digital platform that facilitates the creation, management, ticketing, and promotion of events. The platform connects event organizers ("Hosts") with individuals seeking to attend such events ("Attendees"). Eventcone is not the creator, organizer, or owner of the events listed on the Service. The Host is solely responsible for ensuring that any event page posted on Eventcone and the nature and conduct of the underlying event meet all applicable local, state, provincial, national, and other laws, rules, and regulations.
3. User Accounts
- Registration: You may be required to register with the Service. You agree to keep your password confidential and will be responsible for all use of your account and password.
- Accuracy of Information: You must provide accurate, current, and complete registration information. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate.
- Age Restriction: You must be at least 18 years of age to create an account and use the platform for hosting events. If you are under 18, you may only use the platform under the supervision of a parent or legal guardian.
4. Payments and Ticketing
When purchasing or selling tickets on Eventcone, you agree to the following terms:
- Payment Processing: We partner with third-party payment processors, including Paystack, to facilitate secure transactions. By transacting on our platform, you agree to be bound by the respective terms of service of these payment processors.
- Fees: Eventcone may charge a platform fee and/or payment processing fee for each ticket sold. These fees will be clearly displayed before you complete your purchase or publish your event.
- Refunds: Because Eventcone serves as an intermediary, all refund requests must be directed to the Host of the event. Eventcone is not responsible for issuing refunds, except where required by law.
5. Technology Partners
We collaborate with trusted technology partners, including Haqqman Technology Limited, to ensure the optimal performance, security, and maintenance of the Eventcone platform. By using the Service, you acknowledge and agree that our partners may process platform data on our behalf, strictly in accordance with our Privacy Policy.
6. Content and Conduct
You may not access or use the Service for any purpose other than that for which we make the Service available. As a user, you agree not to:
- Post or host events that promote illegal activities, violence, hate speech, or explicit content.
- Interfere with, disrupt, or create an undue burden on the Service or the networks connected to the Service.
- Attempt to bypass any measures of the Service designed to prevent or restrict access to the Service.
- Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use of the Service.
7. Intellectual Property Rights
Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service.
9. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
10. Governing Law
These Terms shall be governed by and defined following the laws of Nigeria. Nextcone Technologies Limited and yourself irrevocably consent that the courts of Nigeria shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
